Rights as Warning Lights

 It is sometimes suggested that utilitarianism is apt to inadequately value people as individuals. If we are aiming to maximise utility across all people, then the welfare of one individual can be sacrificed indefinitely so long as this produces greater benefits to others. In order to avoid this conclusion, people posit human rights which stand prior to the existence of society and the state.

This depends upon a view that rights are “trumps” – that when activated, they invalidate or outweigh other political considerations such as efficiency or equality. I think this is mistaken – rights are more like warning lights. The “warning lights” view of rights is not intrinsically tied to utilitarianism or consequentialism, but they go well together – my introduction to this way of thinking was a podcast in which Philip Pettit argued that itresolves some problems for consequentialist views.

 

Is it right to sacrifice the life of one person in order to save five? For example by turning a trolley? By pushing a man off a bridge? By killing a man and redistributing his organs? By triaging patients in a military hospital? The only honest answer to the original question is “it depends” – you can’t give a universal answer, you have to attend to the particular situation which you face. These are difficult questions, and abstract theory should not give us easy answers – but it should at least identify which are the hard cases and which are the easy ones. (See also - in the case of a pandemic, should we restrict the movement and association of millions of people in order to avert a certain number of deaths?)

Treating rights as trumps is frankly a very glib way of responding to these questions. “The one person has a right to life” is a simple answer, not a serious one. Ronald Dworkin might redefine his position to “the one person has a right to life, but only in those situations where the five people do not,” but that just becomes an outright evasion of the question.

What about the “warning lights” picture of rights? We say that the one has a right to life, and so we will want to deliberate carefully before we violate that – but in the end we may recognise that the situation merits overriding the right. Or we might decide that in this case, the one should not be sacrificed.

 

This hasn’t really discussed utilitarianism as such, so if you believe utilitarianism fails to adequately respect individuals then this shouldn’t persuade that it does. What I hope this does show is that if you hold that view, invoking rights is not the solution.

Some Early Thoughts on The Machinery of Government

I'm enjoying Joseph Heath's latest book, The Machinery of Government. It has particular relevance to me at present, as a UK civil servant currently working on implementation of the NI Protocol, where the UK Government is currently taking what we might describe as a "high legal risk" approach.

At present I've read the first three chapters ("Taking Public administration Seriously", "A General Framework for the Ethics of Public Administration", "Liberalism: From Classical to Modern"), skipped the fourth and fifth on the welfare state and cost-benefit analysis, and am half-way through the sixth on administrative discretion. I assume that chapters four and five are more developed versions of his previous papers on these topics, but may have missed things which would rebut my criticisms below.

Some things I've enjoyed:

  • Heath makes a convincing case that the topic is under-studied: state officials wield vast vast power which really doesn't have a good democratic justification. He also, I think, provides a solid explanation of where this justification does come from.
  • I have serious disagreements with his interpretation of liberalism, but it's a very clear statement of why he believes it.
  • It's also by far the best defence I've read of the Communitarian/Habermasian idea that moral philosophy is about uncovering the principles implicit in our practices, rather than trying to divine an eternal moral law. He compares it to his business ethics, collected in the earlier volume Morality, Competition, and the Firm: "One of the major problems with traditional business ethics is that it treats morality as something entirely external to the practice of business. As a result, the pronouncements of ethicists tend to arrive like an alien imposition, which in turn gives businesspeople license to ignore them, on the grounds that the expectations are simply incompatible with the demands of running a successful business. My approach, therefore, has been to focus on the moral obligations that are already implicit in market relations, and that are advanced through commercial and competition law, as well as regulation." (page x)
  • To this end, he talks largely about an existing ethos, various written and unwritten norms which exist around civil service practice. I have been thoroughly convinced that this is the correct approach, as opposed to attempting to derive morality separately and then apply it in this case - despite my utilitarian inclinations.

Some things I've thought less of:

  • Every one of Heath's books contains a long history of the topic at hand. His defence of this is that, as a student of Habermas, he believes you can only understand our moral practices through understanding the journey by which we arrived at them. Fair enough - but do you really need 60 pages to do this in a 400 page book?
  • Moreover - it's striking that for all that he talks about the history of liberalism, he does not any attempt to give the history of Westminster-style civil services, despite the obvious relevance of this. If one is aiming to defend a particular view of the principles inherent in civil service, it's fair enough to think that John Locke is more important than the Northcote-Trevelyan Reforms, but I'd expect you to at least make the case. For example, I am not aware of any mention of the latter in The Machinery of Government. Nor is there analysis of actually-existing civil service codes beyond the (admittedly, in my experience accurate) statements that they are often vague and give little to no guidance on how to weigh different values like objectivity, neutrality, etc.
  • Going deep into history inevitably involves a great deal of historical interpretation. There are some glaringly "controversial" examples - to take one which clearly doesn't affect the main thesis, his claim that "Napoleon was able to conquer most of Europe, not because of any technological or tactical superiority, but rather because of the superior organisation capacity of the French state, not least its power to impose universal male conscription upon the population, which made it possible for Napoleon to field massive armies." (p120). He attributes this to liberalism. Conscription was clearly a boon but:
    • (a) logistical innovations which allowed French armies to travel faster, enabling things like the Ulm Maneuvre, were clearly much more important;
    • (b) Napoleon didn't exactly outnumber the Russian and Austrian armies he faced, conscription was at most an equalising force;
    • (c) this really needs a comparison to the Revolutionary Government which preceded Napoleon;
    • (d) why would you use this as your example of liberalism boosting military capacity rather than the well-known example of the UK being able to borrow at lower rates of interest?
  • That example merely raises questions of attention to detail. One which I'll admit to not exactly being expert in, but which frankly seems fatal to his thesis if my understanding is correct - the Wars of Religion were ended not by agreement for states to stay out of religion - to follow liberal neutrality - but agreeing, at the Peace of Westphalia, that each ruler would control religion in his own land, and they would not try to force religion on each others' lands. This did not prevent wars, of course, but it prevented the religious wars which Heath claims liberalism arrived to prevent.
  • His advocacy of a purely political liberalism is fine so far as it goes, but does rather take a lot of the force out of his claims that we don't recognise liberalism for the same reason fish don't recognise water.

Stability and Equality

A lot of political theorists talk about equality as a requirement for social stability, without having an explicit theory of mobs. This strikes me as a significant absence.

Social stability is not just about avoiding mobs, of course - it's also about keeping crime down, ensuring that pressure for change happens through peaceful channels, etc. But the sight of mobs rampaging through the streets is perhaps the most visible failure of states to maintain public order, and is surely a significant piece of what we ordinarily mean and care about under the banner of "stability".

(This is particularly true for theorists at the more cynical end of constructivism, who may regard society as an implicit compact between the proletariat and bourgeousie, in which the proletariat are granted certain rights and privileges in order to stave off revolution.)

I intend this not as a criticism of egalitarians, but as a debating point within egalitarianism. There are a wide range of factors which may plausibly reduce or exacerbate the risk of social disorder, and which have implications for the kind of egalitarianism one would endorse:

  • The perception that the masses have little to lose from rioting (suggesting a need for broad-based prosperity)
  • The perception that social elite possess large quantities of goods worth taking (suggesting a need for levelling down)
  • The perception that social elites acquired their wealth unfairly (suggesting a need for equality before the law, and possibly more besides)
  • The presence of intelligent and hard-working people who are unable to succeed within established institutions (suggesting a need for equality of opportunity, but not for equality of income)
  • The perception that public authorities are biased against particular groups within society (which could point in a number of directions)
...and so on. Moreover, it matters how these interact. For example, one very simple (and highly dubious) model might suggest that all five of the above factors are individually necessary for riots to start. (An uncontroversial case of this is fire, where fuel, energy, and oxygen are all individually necessary for a fire to start.) In this case, we could focus on abolishing only one of the causes - perhaps whichever was cheapest to treat, or whichever cause we find most distasteful for other reasons.

A more realistic model would seek to quantify inequality of various types, and would give them different weights for their contribution to the frequency of riots starting and to the damage caused by riots. It seems likely, then, that if the achievement of social stability requires state action this is likely to require action against multiple different notions of inequality - we cannot focus on a single form of inequality.

I think this is far more a critique of egalitarian theory rather than of practice. John Rawls may have attempted to reduce equality to "sufficient and equal civil and political liberties, and maximisation of the primary social goods available to the worst-off class within society", but actually-existing democratic states are concerned to reduce economic equality, racial inequality, inequality of access to political institutions, ensure equal treatment before the law...

Speculatively, we might also take this an argument against the idea that inequality is intrinsically bad. Theories of the importance-in-itself of equality tend to end up focussing upon one particular conception of inequality. I think we have here a strong argument that no one conception of inequality is likely to satisfy all of our intuitions about the importance of equality, and ultimately the best evidence for egalitarianism - as with all moral theories - is derived from our intuitions.

Three Routes to Elitism

Open and explicit elitism is a greatly underrated political position. Being contrary to the democratic ethos of our times, "elitist" is more commonly a derogatory adjective than a merely descriptive one. In this post, I shall set out three ways in which one might attempt to justify elitism, and suggest ways in which they may be flawed.

Route One: Aren't We Great!

This is the most basic route to elitism, and it is almost as simple as the title above suggests. This is the elitism of pub sessions, of putting the world to rights over a pint or six. Most people probably think that the world would be better off if they were in charge, but the difference is that we - being the cognitive elite, as evidenced by our smart conversations - are actually justified in this belief.

Well, clearly most people who engage in this kind of reasoning aren't justified in it. I actually do think that at least some of the people I know personally are justified in it, but the fact is that even explicitly elitist politics is highly unlikely to put Superforecasters and the like into positions of power. In practice, an openly elitist political system would resemble the average academic department. If we're lucky, a science department where people would at least be highly numerate; if we're unlucky, a humanities department, which are mostly full of "people like Hillary Clinton with faulty BS detectors, poor critical thinking skills, and severe social desirability bias." When one advocates for elitism, one should think of oneself as advocating less for the rule of sensible people like oneself, so much as advocating for the rule of humanities postgrads.


Route Two: Whig History

Count István Széchenyi left an impressive set of institutions around Budapest. The most famous are the Chain Bridge across the Danube and the Széchenyi Thermal Baths, but he also founded the Hungarian Academy of Sciences and the National Casino. In addition to this, he conducted various measures to improve the navigability of the Danube and to open it up to steamships, and wrote a great deal of classical liberal political theory. (Since I'm posing Széchenyi as a champion of elitism, it is interesting to contrast him with another figure of 1840s Hungarian politics, Lajos Kossuth. Kossuth was far better known abroad, since after the collapse of the 1848 rebellion he lived abroad as perhaps the single greatest voice of democratic liberal nationalism. Kossuth is every bit as celebrated as Széchenyi - the square in which the Hungarian parliament stands is named for him - but it is almost impossible to point to anything he established which lasted beyond 1849).

Going back further in Hungarian history, the arrival of the Renaissance in Hungary is credited more or less entirely to King Matthias Corvinus. Corvinus was not dealt an especially powerful hand - he started his kingship as a puppet of his uncle - but he greatly expanded his power by establishing a professional army, introducing legal reforms and curbs on baronial power, and creating meritocracy in state service.

The point at which I am driving is that some people do things. Sometimes these things are good, sometimes they are bad, but ultimately they create a small minority upon which progress is dependent. If you want society to progress, the best you can do is to create processes which select for these people and deliver as much power to them as possible.

One important thing to note is that while both of these lines of thinking lead to elitism, they lead to rather different elites - "Aren't We Great" suggests we want our leaders chosen for their intelligence, while "Whig History" suggests we should choose them for being driven and conscientious.

The biggest objection to this kind of elitism is the conservative worry that they will tear apart all that we have achieved. To be honest I think that's probably enough by itself - political deadlock is annoying, but kicking the machine to make it work is generally bad. One might also question the model of the world on which it rests. It may well be that the emergence of Hungary as a prosperous nation in the late 19th century owes a massive amount to Count Széchenyi, but how many other countries are there whose development could be traced to the positive actions of a single person?


Route Three: If not the elites, then who?

I don't think anarchy is feasible, at least for the foreseeable future. It's not that I don't see anarcho-capitalism as a valuable ideal towards which me might aspire, but that people have yet to breed out their tribal instincts and the abolition of the state would lead in short order to massive demand either for a new one, or to its effective replacement with clans. Given this, it makes sense to have a government which is at least somewhat under our control.

Since there must be a government, there must be someone in charge. So... why not the elites? It's true that power attracts people with unsavoury motivations and brings out people's corruption, but that will happen whoever you put in charge. Good traits - not just things like intelligence, health, and height, but also pro-social and trusting attitudes - are positively correlated for the most part. So if it's a choice between the common man and the credulous, unoriginal, unspiring elite in pantsuits... give me the elite every time.

We Already Have A Voting Lottery

When, on that fateful day last year, the UK voted to leave the European Union, there was a great deal left as yet undecided. There were a great many paths we could have pursued, ranging from the Norway+ options that would have removed us from the European parliament and little else, to the economists' nightmare No Deal scenario. None of these options could at that point be declared "undemocratic", since the referendum gave us an answer to only a single question. Theresa May - or whoever else might have become Prime Minister - could have, if they so wished, declared that "52% to 48% is no mandate for radical change. We will leave the EU, but smoothly and cautiously" and changed very little.

Instead, the narrative very quickly became that the referendum had ultimately been about immigration, and that the British People had ultimately voted to Take Back Control Of The Borders. It's not hard to see why the notoriously anti-immigration Theresa May wished for this narrative to prevail. Moreover, it's not totally absurd - the campaign for Brexit did, after all, emphasise this as a reason in favour of Brexit (though by no means the only one, or even the main one - remember that bus about the money which could go to the NHS?). What is puzzling, however, is the lack of pushback against this narrative. Theresa May may not have wanted to suggest the vote was anything less than an endorsement of radical change, but why have so many other actors, including many who are in principle in favour of immigration, colluded in this narrative and not challenged this interpretation of the vote?

The answer, of course, is that it is a correct interpretation. Not that you could tell this from the Brexit vote alone, of course - referenda are, much like general elections, a quite incredible effort to extract the minimal possible sliver of information from voters. But we have a great many other surveys and polls of public opinion, conducted with great regularity and on a much richer array of questions than the usual choices offered at the polling station. We know that Brits want less immigration, but this is not because given a choice of two highly uncertain prospects, they chose the one likely to involve less immigration: rather, it is because people from YouGov have asked them exactly what their views of immigration are.



An alternative to universal suffrage that almost only ever appears in the academic literature is the "voting lottery". The idea of this is that rather than collect votes from every single person, we select a certain much smaller number of citizens - say, 1000 - and only ask their votes. This would have three key advantages: firstly it would be cheaper ("But you can't put a financial value on democracy!" "Sure you can. In 2011 we rejected AV because it would be too expensive.") Secondly, by increasing the power of those who actually get to vote, it would give them more of an incentive to seriously consider their vote and its impact. Perhaps most importantly, it would provide an opportunity to stratify the sample of voters. Currently certain groups - in particular, the young and various ethnic minorities - are grossly underrepresented by democracy because of their lower turnout. A voting lottery would allow us to ensure that these groups are counted in accordance with their proportion of the total population, not merely the their proportion of the population that turns up to vote.

Now of course many people who encounter this idea have a strong aversion to it. The point of democracy, they say, is in the mass participation. But the fact that our assessment of public opinion comes not from five-yearly general elections but from weekly polls rather pulls the rug out from under this. Voting in an election is screaming into the void: real political participation is happening to be selected for a YouGov survey, and giving your opinion there.

Another common concern is that a sample of 1000 people cannot hope to fully capture the views of an electorate of millions. I'm not married to the 1000 number - in fact, I think it could stand to be more like 10,000. But the basis of all modern polling is the Law of Large Numbers, which in essence states that when you have a process consisting of many small things which are themselves error-prone, but whose errors can cancel each other out - the errors will tend to cancel themselves out. Hence a poll of 1000 people will be within 3% of the true values 95% of the time, and a poll of 2000 people will be within 2% 95% of the time, for example. Yes, the newspaper polls can be wrong, but this is more often due to bias in the way they have selected voters - asking by telephone, or at a particular time of day, or with certain incorrect assumptions about who is likely to vote - which we could eliminate by selecting voters directly from government records.

It ought to be clear where this is leading. How about, rather than maintaining our thin veneer of universal suffrage with all its attendant problems of unrepresentativeness, we acknowledge the fact that we already live in a political system dominated by the voting lottery, and adjust accordingly? Of course there are costs, but there are also real benefits, benefits which we would be much better equipped to realise if we were honest about our political system and learned to live with it.

People have every reason to worry about attempts to disenfranchise them. In the USA, very significant effort goes into attempts to disenfranchise black voters due to their tendency to vote for the Democrat party. But the voting lottery is different both in its intention and its effects: while we would stop even pretending to care about most voters as individuals (as though we ever could in a nation of 65 million!), we would give much greater weight to their views as members of groups. And voting is far from the only way to engage in politics: so long as we have free speech and a free press, those who are not randomly selected for the ballot will have the opportunity to influence the votes of those who do vote though force of persuasion.

There's a Chesterton-like paradox to the suggestion that we should improve our democracy by removing the votes of most citizens. But the idea, I maintain, is not ridiculous. Certainly no more ridiculous than the idea that rather than vote on every single decision, we should delegate this to some 650 people, mostly white men, all living primarily in central London. I urge you to consider being explicit about the voting lottery which we already have - and to consider how it might be put to better use.

The Sufficientarian Case for Feudalism

Most people thing there is something morally wrong with the existence of poverty, to the extent that those who are in poverty - or at least, the government which represents them - is entitled to forcibly extract resources from other people to end, reduce, or ameliorate poverty. This is what is meant by "social justice".

Views of this kind are often described as "egalitarian", but in fact one of the most plausible such views has nothing at all to do with equality. Sufficientarianism is the view according to which there exists a level which is "enough" for people; people below this line are entitled to the resources which bring them up to it, while those above are obliged to provide. Sufficientarianism has a lot of intuitive appeal: it is easy to see how a starving beggar might be entitled to the charity of a billionaire, but it is much harder to see how a comfortable homeowner, who while hardly a billionaire has no concern about where his next meal is coming from, would be entitled to this charity. We might still think a world in which the homeowner and the billionaire were more equal would be better, but this falls quite short of implying that the homeowner or his government has the right to forcibly redistribute from the billionaire to the homeowner.

Similarly we might think that the higher one lies above the line of sufficiency, the greater is one's obligation to bring others above the line; but again, this does not require one to take equality as any kind of fundamental value.

One consequence of sufficientarianism, often considered counterintuitive and sometimes considered damning, is what it implies in a world of people who are all or mostly below the line of sufficiency. If the measure of a society is the extent to which it brings people above this line, this seems to imply that we should worsen the lives of some of those who are already below the line in order to bring some others above the line. In extremis, with a world of 100 people narrowly below the line, sufficientarianism may require us to utterly ruin the lives of 99 of these people in order to marginally the life of the 100th so that she reaches the line.

There are of course ways to avoid this conclusion, but I sometimes think we are too quick to reject it. Suppose 100 people are caught in a prison camp, and all would rather die than continue to endure this miserable existence. To wit, they hatch an audacious escape plan which will enable a small number of their fellows to reach freedom. Those left behind will be heavily punished and tortured for their roles in the plot, so the plan could hardly be less egalitarian - yet it is still worthwhile going through with, and it is worthwhile for those left behind to suffer for their fellows.

Is there a clear historical example of this? Indeed there is, and for much of history it dominated our planet. The idea that most people could live good lives is a distinctly modern one, a product of the industrial revolution. Before that, poverty, starvation, and abject misery were the norm and indeed the only possibility 99% of the world's population. Simultaneously, however, there existed classes of knights who enjoyed lives vastly greater than any villein or serf could have hoped for: eating well (by the standards of the time), enjoying education (such as there was), and without having to engage in backbreaking labour in the fields.

It is my contention that from a sufficientarian perspective, such arrangements made perfect sense: almost everyone below what should be considered an acceptable level of wellbeing, but by the sacrifice of the many a few were enabled to live  genuinely worthwhile lives.

In the modern world, with abundant food and water, with indoor plumbing and heating, it is hardly necessary to impoverish the masses in order to create lives worth living. But in the complacent post-scarcity society, it is easy to lose sight of the kind of sacrifices which were necessary for our ancestors. Feudalism was not a system of brutal oppression; rather it stands as the greatest monument to the nobility of the human spirit: the willingness to sacrifice oneself for the creation of lives which are truly worthwhile.

The Metaethics of the Harry Potter universe

The field of metaethics is broadly concerned with the following questions: are there any true moral facts? And if so, how can we come to know them?

As an example of what this would mean: take natural-rights libertarianism, as espoused by Robert Nozick, Murray Rothbard, and legions of spotty teenagers. According to this theory, there exist certain facts along the lines of the following:

(a) The copy of Anarchy, State, and Utopia upstairs is my property.
(b) For any entity X, if X is my property then others ought not to interfere with my usage of X unless my usage of X interferes with their usage of an entity Y which is their property.

Of course, a lot of attention in this kind of theory will be devoted to exactly what it means to say that an entity is someone's property. A standard response made by a non-libertarian philosopher would be to observe that the notion of property is entirely socially constructed. To bring out the difference between socially-constructed and non-socially-constructed features of things, compare the properties of belonging to a person and of being less dense than water. Whether something belongs to me or my neighbour is determined entirely by the beliefs of society: if everyone believes the copy of ASU upstairs belongs to my neighbour, it's not that everyone is wrong - it's that the book actually is my neighbours, and I will be obliged to return it to him at the next opportunity. If something is less dense than water, however, it matters not one jot what any of us believes - it will float, and all the assertions in the world will not change that.

Since property is socially constructed, then, perhaps we ought to construct it strategically so that it operates to the greatest advantage of all. Thus we might decide to agree that notions such as taxation are baked into the very notion of property: taxation is not theft, but simply the proper functioning of the property system. (There's a more ambitious version of this argument which holds that no property would exist without a state and so submission to the state in general is part of what it means to own property, but this is silly because (a) property has existed throughout history without the existence of states and (b) even if that were not the case, it's not at all clear how the move from an is to an ought is supposed to be occurring here).

One thing that would support natural rights libertarianism, then, would be if facts about property somehow turned out not to be socially constructed but to be intrinsic features of the world in the same way as density. It turns out that there is a well-known fictional universe in which this is the case: the Harry Potter novels, in which a key reveal towards the end of the last book is that the Elder Wand, a weapon of deadly power, never truly recognised Voldemort as its possessor - despite him having wielded it for much of the last book, ever since he ransacked the tomb of Dumbledore, a previous owner of the Wand. Instead, the wand recognised first Draco Malfoy and then Harry Potter as its true owner, despite neither of them having prior to this point even touched the wand. In the Harry Potter universe, ownership is not a social construct but a real and tangible feature of the universe - and so it may well be impossible, even if desirable, to move to a more socially beneficial meaning of the notion of "property".

Libertarians should not rejoice too quickly, however: the way the wand passes between owners almost always involves violation of the Non-Aggression Principle. Grindelwald stole it from Gregorovitch, Dumbledore kept it after defeating Grindelwald, Malfoy ambushed and disarmed Dumbledore, Harry burgled and overpowered Malfoy. While there are substantial facts about property, which stand in addition to the facts which are known through science and empiricism, they are surely different from the facts which libertarians would have us believe. Perhaps not entirely different - wands aside, most objects seem to behave much as they do in the actual universe with regard to owners - but not the same either.

As a final aside, it is interesting to note that this universe also contains one of the more notable examples of a society with markedly different but non-utopian rules concerning property. I refer, of course, to the goblins, who believe all objects to truly belong to their makers: one cannot purchase an object, only rent it for life. To pass on to one's heirs something that one did not produce oneself is regarded by goblins as theft. Unless the original maker of the Elder Wand is still alive (and according to tradition, the wand was in fact made by Death Himself), this theory must surely remain live as a possible metaethical truth about property in the Harry Potter universe.

Free Speech and Violence

Suppose Alfie hits Betty. We would hold Alfie responsible.

Suppose Alfie throws something which hits Betty - that is, the harm takes place at a distance. We would hold Alfie responsible.

Suppose Alfie throws something and doesn't check that he's throwing into an empty space, and consequently it hits Betty. The harm was not strictly intended. We would nevertheless hold Alfie responsible.

Suppose Alfie throws something which hits something else, which falls on Betty. The harm does not flow directly from Alfie; nevertheless we would hold Alfie responsible.

Suppose Alfie throws something which hits another person, who stumbles into Betty quite heavily. The harm flows through another person; nevertheless we would hold Alfie responsible.

Suppose Alfie throws something which hits another person. This person was menacing Betty with a knife, and consequently stabs her. The harm was worsened by someone else's actions. But we would still hold Alfie responsible.

Suppose Alfie throws some sound waves, conveniently produced by his mouth, at another person. This causes the person to commit an act of violence against Betty that they may not otherwise have committed. Obviously, Alfie is 100% innocent of any wrongdoing.

Eugenics: The Good, the Bad and the Ugly

Eugenics is the attempt to improve the genetic quality of the human population. Some people might object to the notion that we can talk of "genetic quality", insisting that all people are fundamentally equal and that this rules out the possibility that some genes are better than others. I say this is nonsense. A gene that predisposes you to be unhappy, violent, or stupid, with no other effects, is clearly bad. No parent should want their child to inherit such a gene. If this is contrary to human equality, then so much the worse for human equality.

With that out of the way, I wish to suggest a division of our notion of "eugenics" into three categories: pro-natal eugenics, which aims to increase the number of people being born with preferable genes; anti-natal eugenics, which aims to reduce the number of people being born with less-preferable genes; and improvement eugenics, which aims to improve the genetic quality of people who are going to be born anyway. An example of pro-natal eugenics would be providing financial subsidies for high-IQ couples to have children; an example of anti-natal eugenics would be compulsory sterilisation of people judged to be defective in certain ways; an example of improvement eugenics would be screening embryos for disease among people undergoing IVF treatment.

These different kinds of eugenics ought to be assessed differently. My key thesis here is that improvement eugenics is clearly desirable, pro-natal eugenics is likely to be anti-egalitarian but that the good consequences may well outweigh this, and that confusing these with anti-natal eugenics is responsible for most of our worries about eugenics. (I'm not going to take a strong position on whether anti-natal eugenics might be overall justified, but it seems far more problematic than either of the other kinds).

There is a risk with any of these programs that policy-makers will seek to promote not good traits but traits which they personally like - for example, particular colours of skin. We should acknowledge this danger, should fight against all such misapplications of eugenics, and may find that the risk of abuse is to high to practice any eugenics. But I maintain that these practical issues are irrelevant to the in-principle-acceptability of certain kinds of eugenics.

Improvement Eugenics

When we talk about ways to improve outcomes for people who will exist anyway in ways which don't involve genetics, no-one bats an eyelid. Controls on lead emissions are obviously desirable. Education, insofar as it represents real improvements in people's capabilities rather than just a form of signalling, is similarly desirable. The only question, then, is whether the fact of these changes being genetic rather than through other mechanisms makes a moral difference.

It does introduce some extra reasons to be concerned, to be sure. Genetic changes are rather harder to reverse than many other kinds of change: if it had turned out that we were wrong about lead and that it was in fact vital to children's development, we could start pumping it into the air and would within a few years fix much of the damage caused; if it turned out that an incident of gene editing had significant negative consequences, this would take longer to correct and would require significantly greater resources, if it was even possible. But this does not affect the case, on the level of pure principle, for improvement eugenics.

Some people object that by meddling with genes, we are "playing God". Given that I don't believe in any kind of God, at least in the conventional sense, I'm not inclined to take this kind of argument seriously. Besides which, such arguments seem woefully underspecified. What is that makes fixing people's genes blasphemous, but throwing a ball not blasphemous? Both involve meddling with the world in certain ways which might happen to be either in accordance with or contrary to God's will. I'd be happy to have this discussion with a serious religious thinker willing to supply such a condition, but in the absence of such an interlocutor I feel the attempt would be a waste of time.

Perhaps changing someone's genes involves some kind of interference with their autonomy. OK, but it can also improve their autonomy if it leads to higher intelligence, conscientiousness, or similar. Moreover, it's highly unclear why we should take their natural set of genes as the moral default from which any deviation must be justified.

Ultimately, it's hard to see why we shouldn't edit out things like hereditary diseases from the human genome, unless there are significant side-effects of doing so. Is it right to save life, or to kill?


Pro-natal eugenics

This is more problematic than improvement eugenics. Most obviously, it's likely to involve anti-egalitarian transfers of resources and welfare, since the people we would be attempting to incentivise to have more children would in many cases be those who already have plenty. (Perhaps the solution would be, rather than rewarding high-IQ types for having more children, punishing them for having fewer children? But even if this is judged worthwhile when intelligence we wish to encourage, it becomes rather less palatable when trying to encourage greater procreation by people with genes that lead them to be more pro-social than average, or other things we view as virtuous).

That said, I think in general this ought not to be much more controversial than improvement eugenics. If you accept my arguments that people benefit from existing, and you think that certain people create net positive externalities for the rest of society (and would continue to do so on the margin if there were more of them), then why would you not want more of those people? Yes it has certain inegalitarian aspects, but any good Rawlsian should recognise than in the end we all benefit.


Anti-natal eugenics

This is the bad boy. This is the kind of eugenics responsible for giving eugenics in general a bad name, the kind of eugenics used to justify forced sterilisation of despised minorities.

When considering any kind of anti-natal eugenics aimed at abolishing a condition X, there are two questions to be asked: (1) what does X mean for the quality of life of the person who possesses it? (2) Do people with X tend to make the rest of society worse off?

If the answer to (1) is that X usually makes people's lives not worth living, as with certain medical conditions, then we do not need any kind of eugenic principle to justify preventing people with condition X from coming into existence: we need only a sense of mercy.

If the answer to (2) is no, that they simply end up in a worse condition than the average member of society - so what? Let these people live, let their parents have full reproductive freedom!

The complicated cases come when a person is fully capable of having a life worth living, but would impose costs on society in doing so. Sometimes these costs will be concrete, such as those who are in important ways disabled at a young age and so require another person to act as a full-time carer. Sometimes they will be harder to detect, such as the stuff Garett Jones writes about. My tentative inclination is to think that some anti-natal eugenics may be permissible in such cases, but I cannot claim to have thought this through in any great detail. Moreover, any interests society may have in avoiding these costs must be weighed against various interests - in particular procreative interests and bodily autonomy - of the would-be parents of children with condition X. Paying criminals to be sterilised is probably acceptable, mandatory sterilisation is probably not.


Conclusion

Eugenics gets a bad rap due to the genuinely reprehensible things which it has been used to justify. However, eugenic interventions aimed at improving the genetic quality of people who will be born in any case and/or at increasing the fertility of people with desirable traits are in principle morally acceptable - though we might nevertheless have justified worries about the practicalities of such programs.

How Have My Political Views Changed Over Time?

I sometimes wonder if I'm too locked into my political ideology. I have been a libertarian of some sort basically as long as I've known what the word means, i.e. about seven years. However, in that time my views on various individual issues have changed; hopefully this means that the fear in my first sentence is not too accurate?

In any case, here is a set of notes I came up with when trying to work out how my views have changed. The four big driving forces between the changes have been:

-I became much less confident in the possibility of "moral truth", which (a) reduced my commitment to making everything fully consistent and (b) made me more sanguine about advancing political positions on aesthetic grounds. (This is quite possibly a negative development; that said, it made it easier to be honest about my real motivations for some policies, e.g. monarchism).

-aged 18, I was a committed Christian and so if I were to hold a belief about politics, either it had to be consistent with Biblical teachings or I had to twist my understanding of the Bible to fit my political leanings. (I remember being very upset when I read Exodus 3:22, which seemed like a blatant endorsement of theft). Between October 2013 and April 2014, I became convinced that Christianity is false.

-in Sixth Form and the first year of undergrad, I knew no other libertarians and the closest I could find to people who agreed with me were a couple of socially-liberal Tories; during the second-year of undergrad I got to know Sam Dumitriu, who eventually got me to start using Twitter, with the result that I quickly fell in with the #MCx crowd. We are all influenced by the people we talk to, partly because of honest intellectual influence but mostly because of a desire to fit in and look cool; hence my move to "neoliberalism" over "libertarianism".

-partly due to my loss of faith in deontological libertarian moral realism and partly due to people on Twitter - most obviously Sam Bowman and Ben Southwood - I became much more utilitarian. It's hard to date this exactly, but I particularly remember one afternoon of summer 2016 spent walking in County Kerry with my dad, when I concluded that either one took the Enlightenment seriously or one didn't' If one didn't, then what resulted was a tribalist, emotivist politics that was honest, if barbaric. If one took the Enlightenment seriously, then either one concluded that other people matter - in which case, why not go all the way to utilitarianism? - or only oneself matters, in which case ethical egoism results. Concepts like citizenship are attempts to maintain the visceral emotional appeal of pre-enlightenment politics in a post-Enlightenment context, but I think this attempt is ultimately dishonest. Emotional appeal ought to be abstracted as far as possible (which is not the same as removed!) from a political system based on reason. I've moved away from this somewhat since, but remain basically utilitarian.

With that overly long explanation out of the way, a list of fifteen ways in which my views have changed (still in note format but with some explanatory links added, I'm not going to tidy this up):

-used to consider anarchism to be the moral ideal towards which we should aim. Circa 2014 concluded that it was probably both viable and better than status quo, but minarchism to be preferred as a way of controlling negative externalities. Nowadays (since early 2017) suspect it may be unstable due to people's tribal instincts - though still would like to see it tried!

Given the supposition of a government:

1-used to advocate "liquid democracy". Now heavily opposed to anything approaching direct democracy, and would advocate for UK and other major liberal powers to be less democratic on the margin. Had a period of extreme scepticism of democracy due to Jason Brennan (circa early 2013-late 2016 or early 2017); now think it has important instrumental-expressive purposes in maintaining public order.

2-used to be uneasy about redistribution in principle, but would tolerate sufficientarianism. Now at peace with the principle of redistribution, though heavily concerned about *how* it is implemented. Partly due to Joseph Heath (ctrl-f "risk-pooling"), partly due to becoming more neoliberal/utilitarian, which is probably more due to the people I talk with than due to any particular argument. (Took a long time, but roughly late 2013-mid 2016)

3-used to be heavily opposed to military interventions. Now cautiously in favour, largely due to the influence of Mugwump. (still in flux)

4-used to be heavily concerned about tax rates. Still think they matter, but no longer consider them the highest priority. Always thought *how* we taxed matters, though have a more sophisticated understanding of taxation theory than I did back then. Used to advocate negative income tax; now prefer progressive consumption tax.

5-realised free trade is about much more than tariffs and quotas - free trade agreements serve a genuinely valuable purpose. Relatedly, was eurosceptic; switched to being pro-EU around late 2014, as a result of debate preceding the referendum became vastly more pro-EU. (Possibly also related to change in self-image due to living in Hungary for two years).

6-was unconcerned about fertility. Now consider it a top priority, mostly due to Nancy Folbre though partly due to combination of Parfit/Cowen on discounting the future with my own work opposing antinatalism. (early 2015-present)

7-used to assume that Austrian goldbuggery was sensible. (How embarrassing!) Have given up having strongly held views on monetary policy, though Scott Sumner is fairly persuasive. (change around early 2013 - mid 2015?)

8-as natural-rights libertarian, assumed there was a definite answer to whether or not intellectual property was valid, leaned towards not. Nowadays take a much more utilitarian view, thinking that in purely instrumental terms there should probably be some but less than we currently have.

9-was pro-open-borders. Now merely think we should have open borders for citizens of other liberal democracies, and higher but not unlimited immigration from less liberal countries. Didn't care about integration, seeing it as a service provided by host country to people who should be quite happy to reap the benefits of moving to a richer country; now see integration as an act of self-defence. (2016?)

10-thought we should tolerate more terrorism. Still think it's greatly overrated as a threat, but think that (a) preventing people from overreacting is intractable, and (b) costs of anti-terrorism much smaller than I thought back then.

11-struggled to find a reason to be monarchist while still being anarchist. Now I'm (a) less of a moral realist so happier to advocate political institutions on aesthetic grounds, (b) equipped with evidence that Habsburgs were good for Mitteleuropa.

12-was heavily opposed to existence of national debt. Now think morality of national debt dependent upon other institutions, in particular with how much we do to encourage fertility. (2015-early 2017, especially more recently with my work opposing anti-natalism: I came to think that we ought to subsidise procreation, but it seemed fair that the people benefitting by being born ought to bear the cost of subsidies)

13-felt reasonably comfortable with Conservative Party. Also thought UKIP were alright. Think Tories and Labour worse than they were back then, probably happier with Lib Dems than I was. (this probably more due to changes in the parties than changes in my own views, however)

14-thought strong governments (and consequently FPTP) were hugely important. Don't think I had any good reason for this belief. Now hold no strong opinions on this beyond "it depends". (Don't know when this changed, but probably not before 2011 AV+ referendum)

15-now advocate returning the Elgin Marbles. Felt awkward about this in much the same way as the monarchy insofar as I thought about it at all; this Ed West tweet convinced me that they ought, so long as Greece can look after them (which it admittedly might not be able to given the current economic situation), that they ought to be returned ASAP. (This is perhaps the only change in my views which happened in a single moment rather than over time).

Christiano's Renewed Defence of Democracy; or, Rule By The People For The People, Except Without The People

These are interesting times at CEU, but that did not prevent a public lecture by the famous political philosopher Thomas Christiano from going ahead. Christiano is perhaps the world's leading democratic theorist, having put more sustained thought and brainpower than anyone else alive into the defence of this ideal. His talk was specifically responding to a series of critiques made in recent years by Bryan Caplan, Jason Brennan, and Ilya Somin, all of whom argue that democracy is undermined by the poor quality of voters.

Christiano began by briefly setting out a key claim, difficult to dispute, that on a variety of metrics - economic growth, protection of human rights, avoidance of war - democratic nations have tended to enjoy greater success than alternative regimes. This is something that our social scientific theories ought to be able to explain.

He followed this by introducing Caplan's theory of the "rational irrationality" of voters. This theory emerged as a response to the "rational choice" theory of voting behaviour, which held that voters behave in their own interest - that is, voting for the parties and policies which stand to benefit them, as individuals, to the greatest extent. Caplan noted that this assumes voters already know which parties and policies best serve their interests, and pointed out that due to the vanishingly small chance that one's vote could ever change the outcome of a national election, the expected benefit of voting wisely could never exceed or even equal the costs of acquiring such knowledge. Indeed, from a rational choice standpoint, it is difficult to explain why one even takes the ten minutes to walk or drive to and from the polling station. So we have a morass of deeply uninformed voters, who are in no way suited to the task of choosing a government and its priorities. Caplan's argument is borne out by multiple surveys which find the average member of the public to be comically ignorant of fairly basic facts of day-to-day politics. If one cannot name the chancellor of the exchequer, what hope does one have when trying to assess complicated macroeconomic theories which do not even command agreement among experts?

Next, Christiano discussed Brennan's argument for how ideology corrupts our political judgements. Brennan provides three models of individual voters: "Hobbits", "Hooligans", and "Vulcans". Hobbits correspond largely to Caplan's picture of people with no clue of even the most trivial facts of politics; Hooligans are arguably worse, possessing some degree of political knowledge but also being highly ideological and more interested in ensuring the victory of their team than in seeking the best outcome overall. Vulcans, by comparison, consider all available evidence in a relatively impartial way, and contribute honest and valuable information to democratic decisions. A democracy of Vulcans might very well be a good system, Brennan says - but the world in which we live is one in which most people are hobbits, the overwhelming majority of the rest are hooligans, and Vulcans - if they even exist - are a microscopic minority. This is all backed up with social science to demonstrate that most people are as Brennan claims them to be. So while it might be nice to live in a world of Vulcans, Brennan says, that fact is that we do not - and our institutions ought to reflect this, in a way that universal democracy simply does not.

From here, Christiano said, Brennan, Caplan, and Somin - libertarians all - conclude that we ought to adopt alternative systems, with Brennan and Caplan suggesting the rule of experts and Somin suggesting a sharp reduction in the role the government is allowed to play in our lives. In particular, all three advocate a greater role for markets in decision-making.

I don't think this is really a fair characterisation of their positions. In fact, I would say it is an outright misrepresentation of Brennan's position. It is unfair on several counts:
-By "epistocracy" Brennan doesn't mean confining politics to the elites with no-one else able to break in. Rather, he has in mind tests of political knowledge, which one would be required to pass in order to vote.
-More fundamentally, Brennan does not actually advocate epistocracy! Rather, he suggests that it is a potentially-viable alternative to democracy, and that our institutions should not be built on the assumption that all citizens will behave as Vulcans. This is an understandable mistake, given Brennan's other writings; on the other hand, both he and Caplan are avowed anarcho-capitalists, so the only sense in which they can possibly be seen as supporting epistocracy is as an improvement over what we have rather than as an end goal.
-While they indeed believe that markets should play a greater role in our society, and believe (in line with the evidence showing that both social and economic liberalism correlate positively with both intelligence and with being politically informed) that the effects of a higher-quality voting population would be to give markets such a role, this is not (at least for Brennan) a core claim. The argument is that better voters would give a better set of political institutions, without any claims about what those institutions would necessarily be except as illustrations of how our current institutions are ludicrously sub-optimal.

Christiano then boils the debate to the following argument:

(1) Voters are subject to rational irrationality, ideology, and other such biases.
(2) If voters are subject to rational irrationality, ideology, and other such biases, then democracy will fail to work well.
(3) Democracy will not work well.

This, then, is the anti-democratic theorists' view in its simplest form, as a simple modus ponens. But, as he said at the beginning, the conclusion is false! Therefore, since the argument is valid, we know that something must be awry with at least one of the premises. Christiano suggests that Brennan et al overplay the evidence for (1), but does not wish to challenge it too much. The problem, he suggests, is therefore with the assumption that these various biases preclude voters from making good choices about who to vote for.

How can this be? To point towards a solution, Christiano attempts to turn his opponents own arguments against their views, by suggesting that the same problems which they attribute to democratic choice apply in the same way to ordinary decisions made within markets. There is then a dilemma for the anti-democratic theorists: either they admit that markets are just as flawed and so democracy may nevertheless be the best system we can get, or we identify some mechanisms by which individual ignorance can be translated into rational decisions.

There is undoubtedly some small truth to this. I have no idea how to repair a car, but this lack of knowledge on my part does not prevent me from hiring a mechanic - that is to say, from outsourcing the relevant expertise. I do not have the time to form opinions on an especially wide range of books, but I can outsource this to people whose comparative advantage lies in quickly reading and accurately assessing the merits of books.

So, Christiano suggests, such sources of information exist for politics. Moreover, they are often available at little or no cost, and include the following:
-newspapers and television
-political parties.
-friends and colleagues.
-many educated people need to understand political events for their work, and so understanding it for voting purposes comes at no marginal cost
-labour unions
-churches

One worry he admitted to this is that these institutions for informing people need "warning lights" for when they are failing to accurately transmit information. When one goes to a mechanic, it is usually quite clear whether the mechanic genuinely has their claimed skills, due to the success condition in which your car starts moving again (or passes its MOT, or whatever). It is not clear exactly what these are intended to be with regard to politics - The Guardian criticises Theresa May but as a left-wing paper they would say that, wouldn't they? And if one takes the criticism seriously, then without becoming something of an expert oneself, how can one establish whether or not the criticism is accurate?

One possibility, which I'm reading into him though not, I think, unreasonably, is for there to be legal requirements of neutrality or truthfulness applying to political broadcasters, as exist in the UK and Canada but not, infamously, the USA. The big worry with this, as Christiano notes, is that in principle democracy is rule by the people made on their own terms. Is it not contrary to this spirit to compel certain terms of discourse upon them?

OK, so that's Christiano's perspective, presented in what I think is a fairly reasonable and sympathetic way. I have a fair few criticisms, and will work up form smallest to largest.

First, his admittedly-only-a-hypothesis about the role of unions seems highly dubious. He suggested that the decline of unions made working-class populations vulnerable to demagoguery and so is responsible for the current malaise of "the US, the UK and France." But this just seems empirically ridiculous: first, demagoguery was just as potent a force in the days when union bosses would trip into Number Ten for beer and sandwiches. Second, Thatcher gutted the unions in the 80s: why did it then take more than thirty years for demagogues to come along for the working class vote? And finally, France suffering from not enough unions? Are you joking, or are you merely unaware that their transport systems are routinely shut down by disgruntled farmers, taxi-drivers, or whoever else is the angry industry of the day?

Second, I think Christiano overestimates the extent to which even intellectually demanding jobs require one to know about politics, and the extent to which such knowledge represents a very thin and impoverished of the infinitely complex reality. As an example: my dad works in estate and property management for the University of Birmingham, and had a great grievance with the EU that whenever he wished to outsource some work, anti-corruption legislation originating in Brussels required him - as an employee of an organisation recieving significant EU funding - to put it out to tender (including, of course, an expensive advert in a Brussels-based EU-approved journal) and placed certain restrictions upon who he could hire. As a result of this, such outsourcing decisions became vastly slower and vastly more expensive, since in the absence of such regulations he would simply have called up a handful of small local firms, asked for quotes, and gone with the cheapest who he thought could actually deliver at the price they gave. (Of course, the regulations require that he hire the cheapest firm, with the result than from time to time they will not manage to keep to the agreed price, and it is rare that this situation does not end up costing the university further money).

My dad has a deep knowledge of one particular aspect of the way the EU affects Britain. Does this equate to a knowledge, or even a reasonable idea, of what the EU is like as a whole? Of course not. (Incidentally, my dad was turned off by xenophobic messaging of the Leave campaign during the last few days before the referendum, and ended up abstaining; since the referendum, he has been quite enthusiastic about its result).

Third, and moving on to more serious criticisms: Christiano appears to go straight from the uncontroversial claim that democracy correlates with various desirable outcomes to the highly dubious claim that democracy works well, i.e. that it is causally responsible for these outcomes. I've seen a plausible case that democracies can enjoy lower borrowing costs, but otherwise this seems entirely to get the causal direction the wrong way round: countries liberalise economically, this creates a growing middle class, and so a demand for democracy. The economic success of the Asian Tigers is not to be explained in terms of their (anaemic) democracy but in terms of their liberal economic institutions. (And before one tries to argue that they have failed to respect human rights, (1) be careful you're not assuming your conclusion by taking democracy to be a human right, and (2) economic growth is highly underrated as a means to securing people's vital rights to food and shelter).

Fourth, Christiano seems to me to ignore, in an utterly irresponsible way, the quality of information being received. To quote him almost word-for-word: "In the US, I find that I agree with the values of the Democrat party... and this means that they can act as a way to distill complicated information to me." If I had not heard this from his own mouth, I would have assumed anyone attributing these words to him to be creating a strawman. Yet on the grounds that they share his goal of helping the poor more explicitly than their opponents, he is apparently willing on precious little further authority to commit to controversial views on a wide range of topics - the optimal minimum wage, the optimal response to global warming, the optimal level of US involvement in the Middle East...

Fifth, and to the extent that it succeeds most damningly, how different is what Christiano proposes from that which he opposes? If all were to vote the party line, we would have an esoteric epistocracy in which the relevant measure of knowledge would be "Are you a party leader?" It will not be this extreme, of course, with hopefully a range of alternative media sources. But insofar as his vision of democracy is parties telling voters what to think, and the voters consequently choosing parties to implement their policies - why not cut out the middleman, and let the social elites get on with ruling the country untrammelled by the inconvenience of needing to face election? (This, I should note, is the criticism in which I have least confidence).

Perhaps an argument could be made that voters don't really need the knowledge that Brennan thinks they do. More information is not always good, after all.  Apart from this, there are plausible cases for democracy which do not rely at all upon claims about its ability to make decisions. But Christiano's case for this is thoroughly unconvincing, to the point where I was inclined to wonder if his claims to know little of day-to-day politics were not, in fact, just modesty.

How to be Practically Perfect in Every Way

There is a great danger when reviewing a book on a contentious subject that one ends up concluding "the bits I agreed with were good, the bits I disagreed with were bad". This review won't quite say that, but comes closer to this sentiment than I am really comfortable with.

I came to Practical Ethics with mixed expectations. On the one hand, it came highly recommended by people whose opinions I take very seriously, and after all there's a reason why Peter Singer is widely considered one of the greatest philosophers of our time. That said, I've been disappointed by some of his writings in the past, and had kind of got the impression that while he has great and original ideas his attention to detail was not always the greatest.

Well, that's a highly unfair characterisation of him. The first half of Practical Ethics, at least, is a masterpiece of clarity. He discusses the possibility of racial differences in cognitive abilities dispassionately, demonstrating that belief in it is utterly consistent with a liberal worldview. I didn't really learn much from that discussion, having thought about it plenty beforehand, but it was remarkable to see it discussed with such courage by an important, politically-left-of-centre public intellectual.

Similarly, his discussion of abortion demonstrates the problems with the main arguments advanced by both sides of the debate. Ultimately I disagree with Singer - he really ought to give moral weight to benefits enjoyed by individuals whose existence is dependent upon the decision we make - but he demolishes thinkers regardless of which side they are, and while the position he arrives at (support for post-natal abortions) ought to be a reductio of his premises we are left in no doubt either of his sincerity in advocating it, nor of his understanding the issue on a very deep level. (Personally, I'm in favour of something slightly stricter than the UK system - abortions being available on demand up to about 20 weeks of pregnancy, and after that in cases of medical emergency only).

One passage I found particularly illuminating of his discussion of what is particularly wrong with murder. Prior to reading Practical Ethics I had a vague sense that we ought to take the interests of non-human beings into account (i.e. concern for animal welfare) but that actually holding rights was something to do with being human and a full agent. I'm now much more persuaded by Singer's view, which is similar but attributes the possession of rights to those beings which conceive of themselves as existing through time. I can't say I'm 100% convinced, but Singer acknowledges the weak points of his view - e.g. the implication that murder is not so much a wrong to the person murdered but rather to the other people around - and, unlike many philosophers who paper over the holes in their arguments and hope we won't notice, draws attention to this problem.

With all that said in defence of the book, it's worth noting some issues I had. The first is in his discussion of equality: Singer defends his utilitarianism as "equal consideration of interests". That's one form of equality, to be sure, and it sounds a lot nobler than "equal marginal utility of consumption" (as Amartya Sen amusingly describes utilitarianism). But does it really come close to our ordinary notions of a worthwhile conception of equality? Utility monsters are one problem for this view - Singer ends up committed to the view that we really ought to give them all of our resources and debase ourselves before them - but more fundamentally, equality talk is at least somewhat about grabbing. It's about preventing one member or group within society from coming to dominate the rest of us. The union gangmen may not represent an admirable form of "equality", with their happiness (for example) to beat up anyone who dares vote against the party line, but ultimately that's what our equality instinct developed to achieve. Singer should either accept this, or he should find a genuinely noble ideal (like pure happiness! It's not difficult) upon which to base his utilitarianism.

Second, his discussion of the social discount rate - while drawing attention to a severely neglected issue, and not so far from the truth on the issue - failed to mention the absolutely crucial difference between what Tyler Cowen calls the "pure preference rate" and differences in the marginal utility of consumption across time. One cannot simply compare £50 now to £1000 in 100 years, observe that the one is a much greater number, and conclude from this that it is to be preferred. If we replace pounds with utils, then of course such a comparison is appropriate - but this is not what Singer did, and his chapter on the environment suffers in clarity for it. (My discussion here is much less exact than I would like, relying upon vague memories of a Cass Sunstein paper that my google-fu skills have failed to turn up).

Overall, though, the book is very much worth reading - both as an introduction to the subject of applied ethics, and as a contribution to the ongoing debate. I note also that there are several sections which are very much of use to my thoughts, but which (unlike e.g. his argument for post-natal abortions) I would not have picked up just from reading reviews. So this is at least one data point in favour of reading whole books rather than just review of them, even on relatively-easily-summarised subjects such as philosophy.

Preparing the Ground for Tyrants

I've seen a couple of libertarians sharing the following graphic on Facebook, commenting upon how much sillier it looks a year later now that Donald Trump is the president-elect:


I'm not certain how useful this video is to my general point, but it feels kind-of related: Obama mocking Mitt Romney during the 2012 debates for viewing Russia as the "number-one threat to America":


These are statements which were made with utter confidence by Democrats at the time, which they now are very eager to repudiate. A related phenomenon has been the inflated stature, under Obama of the executive order. Obama has not, by the standards of modern presidents, issued an especially large number of executive orders: indeed, the last president to issue fewer orders during two terms of presidency was Grover Cleveland in the late 19th century. But by using them to cause the enforcement of laws which Congress had rejected, he has prepared the ground for Trump to do whatever he likes, even beyond the probably Democrat landslides in the 2018 midterm elections.

This brings us to a general point, one made frequently by libertarians and classical liberals: that designers of political systems rarely stop to think what will happen if the wrong people are able to take charge of the country. But this is an inevitable fact of politics: democracies elect bad men, great leaders make poor choices of successor, and revolutionary governments are almost by definition founded by men with a taste for violence. This fact is one that we should take into account when setting up our laws and institutions, and there are three basic responses you can give:

(1) The freedom of action of political actors must be severely curtailed, firstly by checks and balances upon what can be done and secondly by limiting the range of actions which any government is able to do, no matter how internally united it may be.

(2) Yes, there are risks to a powerful executive, but they are risks worth taking. There are bad governments, but (at least in the context of a well-functioning liberal democracy) these are very much the exception.

(3) Embrace the hypocrisy, and accept that ultimately what matters is not the meta-level process of how you determine what governments should be able to do but simply what side you are on, i.e. whether these vast powers are being used for a (by your lights) good cause or a bad one.

The people who talk about this problem explicitly seem almost universally to give answer (1). Answer (3) is closer to most people's unconsidered instincts, and I don't actually think it's obviously wrong. (It's uncomfortable for Democrats to oppose Trump doing the very things they championed under Obama, sure, but is it objectively any easier for him merely because Obama did it? I don't know.) I'd be interested to see a defence of (2), which seems to be the option most applicable to the UK.

Various splurges on localism, devolution, state-building, and standardisation

NB: quite possibly conflating issues which are superficially related but really ought to be kept separate. Anecdotal evidence and guys with blogs remain anecdotal evidence and guys with blogs, and should be treated as such.
Also, names have been changed.

Back for Christmas, I've recently been catching up with various people I grew up with. In particular, the half a dozen or so lads who are my age or slightly older at the church in which I grew up. Lucias is my oldest friend, who was my best friend in primary school. He studied Maths at Bristol, did a one-year Masters, and is now doing a Ministry Traineeship at his church there. In a few months he will be getting married to a girl he met there.

Jason and Thomas are a pair of brothers who studied Engineering at Cambridge and Geography at Durham respectively; again, I believe they both have Masters' Degrees. They are now both living in London - Jason putting his degree into direct use in designing things, while Thomas (who was a keen athlete in school, having once placed in the top 30 of the Birmingham half-marathon) is now working in sports marketing - he enthused that next year's World Athletics Championship, which he is involved in promoting, will be Usain Bolt's last race as a professional.

Simon and John are the two older siblings of their family. I can't remember exactly what Simon studies, but am fairly confident that Spanish was part of it; he now works in London. John did Geography and French at Manchester, and is now working for the council there while angling towards going for a Master's.

Finally, there's me. PPE at Manchester, then jetted off to Budapest to study for a Master's in Philosophy. Currently applying for PhD programs, with an eye on Toronto. Long-term, intending to move back to the UK and very vaguely hoping to find a job at Oxbridge.

What, apart from our Christian upbringings, do we have in common? We're all bright, well-educated young men who remember Birmingham fondly and want it to do well. But none of us see our futures here.

This is, I think, the kind of thing Tom Forth likes to go on about on Twitter. We'll come back at holidays, maybe chip in to things - my own contributions are primarily playing piano and organ at church, but people really like hearing that organ played, mind you - but in terms of the lasting contributions that any of us could make to our communities, those contributions will be made elsewhere. Thomas noted that of his friends from Durham, "like 99% of them" have also moved down to London. That's simply where the jobs are.

This doesn't seem good for Birmingham. I don't endorse brain drain as a reason to compel people to stay in the third world, and nor do I endorse it as a reason to compel people to stay in Birmingham. But we've received a lot - of the six people I describe, five of us went to schools run by the King Edwards Foundation - and it's hard to see what, if anything, our home city is getting back.



An interesting essay linked to yesterday by Byrne: "The Strange Death of Municipal England". Key claims:
-government should be doing lots of things
-however, these should be done specifically by local government
-in the late 19th and early 20th centuries, this was what actually happened
-however, since WWII local authorities have increasingly had powers nationalised
-the tendency is now towards privatisation of such things, to the detriment of quality/equality of service

The essay is good and worth reading, but at the end I was left with a feeling that if you asked the author why (say) libraries should be government-run but food shops should not, you would not get any kind of a convincing answer. Most egregious is the following passage:
In truth, Britain no longer has a government, but rather a system of governance, the term political scientists use to describe ‘the relationships between governmental and non-governmental forces and how they work together’. This is another way of saying that we live in a half-democracy. 
David Schmidtz has the most articulate and developed response to this way of thinking, which is (roughly) that the fact that we aim to realise particular principles with our institutions does not mean that the institutions ought to aim specifically at the realisation of those principles. This is a line of thought going all the way back to Adam Smith, with the immortal line (and also the only line of The Wealth of Nations that I actually remember):
It is not from the benevolence of the butcher, baker, or brewer that we expect our dinner, but from their regard to their own self-interest.
That's my key point of disagreement with the essay: I don't think the changes it herald are necessarily bad. But that's not why I bring it up here. It's because of the tension it argues for between the national and the local, and the argument (which I am entirely open to, perhaps even favourable to) that nationalisation of politics is bad for most local areas.



The other evening, I had an exchange with Tom Forth on Twitter. We agreed that there are many types of policies which, in terms of total impact, are bad, but are good (or at least perceived as good) by the communities which make them. Examples include import tariffs, US cities bribing sports teams to stay in town, favouring domestic companies for fulfilling government contracts, etc. We agreed it is good that the EU prevents member governments from such practices. Our disagreement, I think, is whether the UK government should prevent localities from such practices. (I'm not certain what these would be, but let's assume that they exist and that more powerful councils would practise them). I, motivated by an overriding moral commitment to the wellbeing of individuals, think that it should. He, motivated by a belief in democracy and in particular local democracy, thinks that it should not. (At least, this is how I understand the disagreement).

If such beggar-thy-neighbour policies exist at the city level, it seems at least plausible that the success of London relative to the rest of the UK is to a fair extent due to it being the only city able to pursue them. Let us suppose that this is a good model for how the UK actually works. In that case, there are three obvious choices we could attempt:
(a) No-one, including London, gets to play beggar-thy-neighbour
(b) Everyone gets to play beggar-thy-neighbour
(c) The status quo: London, and no-one else, may play beggar-thy-neighbour

(a) and (b) have the advantages of moral consistency: (c) is desperately unfair on everywhere except London. But (a) may be entirely impossible to practice, and (b) is surrendering to the collective action problem. So (c) may well be the best option available; indeed, given this empirical model of the world, I would take (a) to be impossible and so advocate (c): in practice, clamping down on decentralisation.




A discussion of the increase in federal power, in particular since WWII, in the US. Worth reading for itself, but a real "huh, that seems obvious in retrospect" moment for me was the point that what we think of as common law bears little to no relation to law as experienced by most people for most of Anglo-American history. Rather, there was a whole mess of conflicting local norms, which in the early 20th century were standardised and codified by reformers.

On a related note, the professor in a Gender Studies course I audited this semester noted that we have records of men in 19th century England selling their wives. Clearly this wasn't a common thing, but it happened in certain places. Legal standardisation, of course, put a stop to that.



The point that I'm getting towards, I think, is an attempt at rebutting the arguments made by James Scott and Jacob Levy against centralisation of power. Or rather, I want to accept all of their claims about what High Modernism causes, and say that it was probably worth it. Or maybe it wasn't. The problem is perhaps inherently unsolvable, since it is very difficult to know what the average state of society was prior to the building of the nation-state. The standardisation which destroyed local knowledge and practice was also what made it possible, even in principle, to assess how individual people's lives were going.

Some people - including people I know personally - would argue that communities ought to be protected and preserved, even if they are what we would regard as backward. But again, I state my belief in moral individualism: people are what matters, and communities are only a means towards the flourishing of people. Perhaps they are important, even crucial means, but when society holds its members back, society is to be cast into the fire.

Does legal standardisation relate to modern devolution? I think it does, in a sense. Forcing the young men formerly of St. Stephen's Church to stay in Birmingham would have been good for Birmingham, and quite possibly good for the other people of Birmingham. But it's no way to treat individuals, it's no way to turn London into the growth engine which will eventually realise the post-scarcity society (or as near to that as possible), and... I don't know. The world is complicated, I don't know. I don't know.

Why Racism Against Oppressed Minorities Isn't Racism

When it comes to generating unusual and (to many people) offensive opinions about morality, scepticism about the ability of anything to affect long-run happiness truly is the gift that keeps on giving.

A relatively tame example is the idea that, since most lives are good, we should therefore devote our resources as fully as possible towards increasing the world population. The moral premises here are controversial but I think defensible - ultimately, total utilitarianism across the span of actually-or-potentially-existing moral patients.

An edgier way to take this is to observe that people from oppressed and marginalised groups are likely to be used to their subjugation due to having grown up in similar (or indeed worse) circumstances, and therefore to suffer far less from it than someone who is thrown into this situation. That is to say, the experience of a white person who suffers racial discrimination is likely to be severely more negative than the experience of a member of an ethnic minority who suffers similar discrimination. Combine this with premises about the interests of all counting equally, and you end up concluding that racism against whites is significantly worse than racism against (for example) black people.

This is a surprising conclusion, and my inclination before endorsing it even tentatively would be to go over the reasoning leading to it with a very fine-toothed comb. That said, if an SJW proclaims that racism is what occurs within a context of oppression and therefore is not significantly problematic when practised against privileged groups, it is fun to be able to argue that they are not only wrong but have precisely the opposite of the truth.

Political Fracture and the Consent of the Governed

It has been a commonplace of liberal, and in particular democratic, political rhetoric that government rests solely upon the consent of the governed. The logical conclusion of this principle, of course, is that every single individual ought to be able to determine the exact nature of the polity in which they choose to live. This is of course an utterly unachievable goal, but it is worth considering how far we can move in that direction - and whether such moves are likely to be desirable.

So far, the closest we have come to achieving this kind of choice is to allow for collective decision-making about how governance should take place. This is, however, a pale shadow of the ideal we are aiming for: collective choice may reflect the preferences of all in a group of four or five friends, but in a nation of thousands - let alone millions, or even hundreds of millions - the individual voice is a mere drop in the ocean.

Another possible way to move in the direction of individual consent is to institute a variety of polities, and allow free movement between these. There are still problems with this system (call it "Archipelago"), both in terms of individual choice and in terms of the practical problems it throws up, but it remains perhaps the closest to utopia we are ever likely to reach. I'm not going to defend it here, but section III of the linked article provides one person's attempts to expose and subsequently resolve the problems with it. As I see it, the principal differences between Archipelago and one inhabited by modern-day Europeans are few but highly significant. These differences can be bridged, but would require substantial, and highly controversial, changes to the current political set-up.

A first difference lies in the vast legal and logistical difficulties faced by anyone attempting to move from one polity to another. The EU has done a considerable amount to reduce the legal barriers, but there are nevertheless very considerable costs to moving. There are the large financial costs, the friends and family with whom you have considerably less contact, the difficulties of learning a new language (or reduced quality of life if you don't learn it), as well as all the frictional costs of adapting to a new set of cultural institutions. Some of these costs are unavoidable, but others could, I think, be much reduced.

The key step to be made here is the abolition of the nation-state. Or rather, the splitting of nations into several different states. The costs of moving from Aldershot to Bath are much smaller than the costs of moving from Austria to Belgium, and that would continue to be the case if Hampshire and Somerset were separate states. It is true that political differences can lead to cultural differences which magnify over time, but the fact remains that after more than 200 years of independence the USA remains the number-two destination for British emigrants - topped only by another former British colony, Australia. In terms of the existing stock of British expats, five of the top six destinations are Australia, the USA, Canada, the Republic of Ireland, and New Zealand. Splitting the UK into anywhere between a dozen and twenty smaller states would allow Brits a real choice of political entities in which to abide.

The second, and perhaps the biggest, difference between Archipelago and the real world is that real world states really aren't all that different from one another. There are differences, but you'll struggle to find a single first-world economy that has anything other than a welfare-state vaguely-capitalist mixed economy. Switzerland has genuine variation between its cantons, with some places such as Zug levying almost no taxes whereas Geneva will tax anything you can shake a stick at, but they are entirely the exception (and of course anyone wishing to move into Switzerland from the outside faces some of the strictest borders in Europe). Achieving Archipelago means being willing to see people recreate communism, fail, and ruin decades of their lives. It means being willing to see first-world countries where women are not allowed to vote and where homosexuals leave as soon as they can. Above all, it means trusting that there will be states like Estonia who try new, exciting and above all good ideas, who will lead the way for everyone else to follow.

Combating Socialistic Tendencies in Old Testament Interpretation

Having written a pro-Christianity post earlier in the month, and given the vast unlikelihood of Christianity being true, I'd better write a few trillion anti-Christianity posts to balance out the religious tone of my blog. To get started, let's just have a couple of brief riffs on a passage of text introducing the book of Isaiah:
[Isaiah] had to contend with many difficulties, for the moral and spiritual condition of the people was corrupt. The rich oppressed the poor, and revelled in wanton luxury; justice was shamelessly bought and sold.
First, I'll take note with the phrase "the rich oppressed the poor". Part of my complaint is that it is so generic: every moral and political programme that has ever existed has had a complaint of this kind (even Objectivism!), regardless of whether the poor were even literate enough to record their complaints for themselves. But more than that, it gives a misleading impression of the nature and cause of the oppression. It was definitely the case in hierarchical societies, such as that of Uzziah's monarchy in ancient Israel, that there tended to be significant oppression of the peasantry by the elite. It was also the case that the oppressors were in general much richer than the people they were oppressing. But the text I quoted gives the misleading impression that it was because of their riches that people were able to exercise oppression, rather than the oppression being the source of their wealth.

Secondly, it is complained that "justice was... bought and sold." Going all Brennan/Jaworsky: what, precisely is wrong with that? My suspicion is that the complaint refers to situations such as the following scenario: Aaron wrongs Bathsheba, so Bathsheba takes Aaron to court. However, the judge, Caleb, accepts a bribe from Aaron to pronounce wrongly, so that justice is not done.

But attributing the problem to "the buying and selling of justice" is misdiagnosing the problem. Rather, the issue is one of misallocation of rights. Let us suppose that Aaron's wrongdoing created a right of restitution, R. We would tend to assume that R is owned by Bathsheba. For Bathsheba to have the right to sell R is very useful: exercising the right may well require time or money that she does not have. Instead she might sell the case on to someone more able to pursue it, and take the proceeds of the sale as her restitution. The buying and selling of justice is not only morally acceptable, but serves a valuable purpose.

The problem, in our case, is that the right of restitution did not in practice reside with Bathsheba: it went to Caleb. Note that Aaron still ended up paying for his crime (though perhaps less than he otherwise would have had to): the problem lies less with a failure to punish Aaron than with a failure to make Bathsheba whole.
